Civil suit stemming from Janklow accident going to trial
February 24, 2008 SIOUX FALLS, SD –– Attorneys have failed to reach a settlement in a wrongful death lawsuit stemming from a fatal crash caused by former South Dakota Rep. Bill Janklow, so a federal judge in Minnesota will decide how much the victim's family is owed.
Both sides met Wednesday for nearly three hours at U.S. District Court in Minneapolis but couldn't resolve it, according to courtroom minutes and one of the lawyers.
Randy Scott, 55, of Hardwick, Minn., was killed Aug. 16, 2003, when his Harley-Davidson hit the back of the Cadillac Janklow drove through a stop sign at an intersection near Trent.
Scott was killed instantly. Janklow was injured.
Scott's family sued the United States for $25 million after the U.S. attorney in Minnesota concluded Janklow was on official business at the time of the crash -- which makes the federal government responsible for any damages.
By March 1, both sides need to be ready to go to trial, which is expected to last three days.
It will be in front of a judge, not a jury, said Ronald
Meshbesher, the Minneapolis attorney for Scott's family.
"We're just ready and alert from that point on," he said.
A spokesman for the U.S. Attorney's office in Minneapolis said federal prosecutors could not comment.
Janklow, who has returned to private practice as a lawyer, was a dominating force in South Dakota politics for 30 years. After serving as attorney general, the Republican was governor for 16 years, serving four terms in two separate eight-year stints. In 2002, he was elected as South Dakota's only member of the House.
Janklow has diabetes and testified he had not eaten the day of the accident and likely blacked out when he approached the intersection.
A jury in his boyhood home of Flandreau convicted him of second-degree manslaughter in December 2003. He resigned from Congress a month later, served 100 days in jail, paid a $5,000 fine, temporarily lost his law license and was forbidden from driving during his probation.
He finished his sentence in the Minnehaha County Jail in May 2004. His three-year probation ended Jan. 22, 2007.
Because Janklow was given a suspended imposition of sentence, his criminal record was cleared.

WATERBURY -- When the Outlaws Motorcycle Club's headquarters was shot at in 2003, suspicion quickly fell on the Diablos Motorcycle Club.
Despite their suspicions, it took years and a detailed investigation into the Diablos before police developed a suspect.
On Friday, more than four years after the shooting, 29-year-old Louis Gibilisco was sentenced to nine years in prison.
That sentence wasn't just for shooting at the clubhouse. It was also for more serious charges stemming from a robbery last February. Police said Gibilisco and an accomplice used a BB gun to rob a man outside Steel Lounge on West Main Street.

With the help of the Motorcycle Riders Foundation (MRF) and State Motorcyclists' Rights Organizations (SMROs) nationwide, the legislation to close the loophole that allows employer-provided healthcare insurance plans to refuse coverage of an injury based on the source of the injury is picking up speed, hitting triple digit co-sponsors in the US House of Representatives. As of press time, the MRF has learned that HR 1076 has
102 cosponsors. Although no committee consideration has occurred in either body of Congress, cosponsors continue to lend their name in support of the legislation.
"HR 1076 and its identical Senate counterpart are fair, bipartisan bills that deserve immediate attention," said Jeff
Hennie, MRF Vice President of Government Relations. He added, "While passing stand-alone legislation through Congress can be likened to moving mountains, if anyone can do it, it's the concerned motorcyclists of America."
This non-controversial legislation has passed the US Senate in the 108th Congress with unanimous consent of the entire US Senate. That's why our work is now primarily with the House of Representatives. While 102 cosponsors are impressive, at this point it's the beginning of the end for the 110th Congress and we have to see major action this spring. The fact is that in an election year that is also at the end of a Congress, legislation can move either very quickly or not at all. It is a known fact that Congress acts at two speeds: knee-jerk and standstill. Let's push this legislation into law. Contact your member of the House of Representatives by any means possible and ask them to support this important legislation.
A quick glance of the list reveals something very interesting. The bulk of the cosponsors are from states that have sent a team to Washington DC to lobby in support of this bill. If you haven't considered sending a group to Washington from your
SMRO, you should because it works. This issue will dominate the MRF legislative agenda this busy spring lobby season, so start planning your trip to DC.
Congress is set to return to Washington next week, please take a careful look at the list below and check for your U.S. Representative. Should you not see him/her on the list, contact him/her via phone fax or email to ask for support of HR 1076. If you do see him/her listed, send a note of thanks.

26 February 2008 The Motorcycle Riders Foundation (MRF) is taking action in light of what appears to be an alarming trend with high-level government agency and cabinet-level appointees of President George W. Bush.
President Bush campaigned for the presidency on a platform of "compassionate conservatism." During his campaign he often spoke of his desire to reign in big government and his commitment to personal freedoms.
His message resonated with many in the motorcycling community and with the leadership of the MRF at that time.
While the president continues to speak of his conservative approach to public policy and respect for the rights of the states during this election cycle, the practices of a growing number of his appointees seem to be in marked contrast with his rhetoric. Both Mark
Rosenker, Chairman of the National Transportation Safety Board
(NTSB) and Mary Peters, Secretary of the Department of Transportation (DOT) have embarked on a course that at first glance would seem out of place in a conservative Republican administration.
Mr. Rosenker appears to be enamored with 1960s era "Great Society" style programs. He is using his agency and his position to pressure every state in the Union to adopt mandatory helmet laws for all motorcycle riders.
Ms. Peters must have a battalion of Philadelphia lawyers on her staff watching over her as she walks on the edge of federal regulations. The DOT secretary is on a budget-busting spending spree that would make a "New Dealer"
blush. She is not content to just spend the DOT's budget on social engineering, she is crafting ways to legally skirt the letter and the intent of SAFETY-LU (the highway funding act passed by the 109th congress)
to scoop up what ever monies she can to advance her personal mission, even if such funds are a meager amount dedicated to aiding motorcycle rider education.
The MRF finds this to be rather peculiar behavior in an administration that bills itself as "compassionately conservative." Perhaps even more peculiar is the fact that the president appears to be comfortable with his appointees' actions. The MRF is certainly not comfortable as we watch these presidential appointees lining up against us.
Our level of discomfort increases as we recall other issues with appointees of the president. An unpleasant tussle with the Environmental Protection Agency set the tone early on in this administration, followed by Dr. Runge at the National Highway Traffic and Safety Administration referring to motorcyclists as the scourge of the highways.
While the MRF will aggressively fight any negative legislation that may be introduced at the behest of these presidential appointees, we will not waste time wrestling with the current lame duck administration that has historically low approval ratings with the American public; we are looking to the future.
The MRF is calling on the leadership of the Republican Party to explain to us and to six million motorcycle-riding Americans if this is the type of public policy that we can expect in the future should a Republican be elected president in November. We will be writing a formal letter to Mike Duncan, Chairman of the Republican National Committee, expressing our displeasure over the course that the current administration has taken and asking for assurances that this is not the direction that his party is going to follow. A copy of that letter will be forwarded to Senate Minority Leader Mitch McConnell and House Republican Leader John
Boehner.
We will also be asking for a meeting with Mr. Duncan, and will present him with a questionnaire on motorcycle-related issues. We will ask that our questionnaire be forwarded to the presidential nominee of his party.
The MRF will be making a similar request to Howard Dean, the Chairman of the Democratic National Committee.
When the questionnaires are completed they will be posted on the MRF website and published in the MRF reports without editorial comment, or any endorsement from the MRF.
