Dutch Judges Refuse to Ban Hells Angels

THE HAGUE, Netherlands (AP) - A chapter of the Hells Angels motorcycle gang in the Netherlands is not a criminal organization, Dutch judges ruled Tuesday, rejecting prosecutors' attempts to have the group outlawed.

The decision is a major setback for efforts by the public prosecutor's office to have Hells Angels clubs banned nationwide amid allegations they are heavily involved in organized crime. The Harlingen Hell's Angels chapter was the first prosecutors tried to have outlawed.

``Based on the fact that weapons and soft drugs were found at the club house in Harlingen, it is apparent that the Harlingen chapter is involved in crime,'' judges in the northern city of Leeuwarden wrote in their judgment. ``But the group has not been prosecuted for those offenses and prosecutors have not indicated they are planning a case.''

The judges said there was insufficient evidence to suggest that the biker gang ``threatens public order to the extent it should be banned.''

``This is the right result,'' said Harlingen Hells Angel member Dirk van der Zee. ``It is not the case that we are all criminals. Prosecutors are trying to tar us all with the same brush.''

The Harlingen chapter's club house was raided in 2005 as part of a large scale investigation into allegations of extortion, intimidation, weapons and drugs trafficking.

That investigation followed the murder of three members of the gang in 2004, allegedly by fellow bikers.

A spokeswoman said prosecutors would appeal the ruling.

AMA Community Council – Treasure Coast (FL) president Frank Walsh has personally be ensuring that all stop lights in his area will recognize motorcycles.
Like anyone who has sat in the piezoelectrically operated box of a stop light on a motorcycle, for seemingly endless amounts of time, Walsh got fed up with going no where, decided to work with the surrounding municipalities and the county to re-calibrate all stoplights to recognize motorcycles. Walsh, who is a retired municipal worker from New York, spent countless hours volunteering his motorcycle for the calibration work.
Several states have recently enacted legislation that would provide for a positive defense should a motorcycle run these lights, as long as certain conditions are met. The American Motorcyclist Association (AMA) announced that bipartisan bills have been introduced in both the U.S. House of Representatives and U.S. Senate that would end health-care discrimination against motorcyclists, ATV enthusiasts, and participants in other legal recreational activities. 
US Representatives Michael C. Burgess (R-Texas) and Bart Stupak (D-Michigan) introduced HR1076, "The HIPAA Recreational Injury Technical Correction Act." On the same day, Senators Susan Collins (R-Maine) and Russ Feingold (D-Wisconsin) introduced identical companion legislation, S 616. 
The bills seek to bar employers from discriminating against those who take part in activities such as motorcycling, ATV riding, skiing, snowmobiling or horseback riding in the health-insurance programs they offer their workers. 
HIPAA originally prohibited employers from denying health-care coverage based on a worker's pre-existing medical conditions or participation in legal activities, such as motorcycling. But later federal bureaucrats reversed the law, writing rules to allow health-insurance discrimination against motorcyclists and others who engage in legal activities like ATV riding, or horseback riding -- employees were guaranteed the right to health-care coverage, but not guaranteed any benefits under those plans. 
Motorcyclists were outraged when federal bureaucrats went against the will of Congress, and the AMA immediately lobbied legislators to right this wrong. Others involved in the effort include the All-Terrain Vehicle Association, the American Council of Snowmobile Associations, the American Horse Council, the BlueRibbon Coalition, the Motorcycle Industry Council, Motorcycle Riders Foundation, and the National Ski Areas Association.

POSSIBLE BLOOD TEST FOR MS 
The finding of at least three biomarkers for multiple scler osis could lead to a simple blood test to diagnose the disease, scientists say. The researchers from Wake Forest University Baptist Medical Center studied relapsing-remitting MS, the most common form, characterized by attacks inter spersed with stable periods. Their findings, reported in the Journal of Molecular Neuroscience, suggest a future blood test might identify the earliest changes that mark MS, says lead researcher Dr. Jagannadha Avasarala. Currently, diagnosis: through patient history, physical examination, the costly magnetic resonance imaging and laboratory testing, such as lumbar puncture is difficult to reach conclusively in some patients, Avasarala says.

POMEZIA, Italy, -- Italian researchers say they've develop ed an AIDS drug that attacks the disease in a new way. "The molecule, MK518, has a wholly new mechanism," Gennaro Ciliberto, head of a molecular biology research institute run by drug company Merck, told ANSA. Ciliberto said MK518 and other "integrase inhibitors" may help AIDS patients who have developed a resistance to other anti-retroviral drugs. 
Integrase is an enzyme in HIV that allows the virus to integrate with body cells, ANSA reported. "If you knock integrase out of the picture, HIV can't possibly infect any one because the virus isn't able to replicate," Ciliberto told ANSA. ANSA reported Merck expects U.S. Food and Drug Administration approval for the drug before the end of 
2007.
