State police have released the names of the two
men who were wounded Saturday after shooting broke out between members
of two motorcycle clubs at the Last Stop bar on East Side at about
4:20 p.m. Saturday.
Richard Benson, 53, of Connellsville, Pa., suffered from a gunshot wound to the head. Leroy R. Case, 48, of Fairmont was shot in the stomach, said Sgt. G.L. Campbell, detachment commander of the Fairmont barracks of the West Virginia State Police. Officials have confirmed that the argument was between the Pagans and the Second Brigade. Details of the incident are still pretty murky. The shooting Saturday sent bystanders running for cover when shots broke out. Officials said that after a group of bikers arrived in the parking lot of the Last Stop on Homewood Avenue, an argument broke out, which progressed to a fist fight. Then shots were fired. Campbell said the State Police weren't receiving much cooperation from witnesses. He added that police believe that 10-15 shots were fired, mostly at the bar. モTwo to three people were shooting into the building from different angles, he said. Handguns were used to fire shots through the front door and back walls of the bar. At this time, no arrests have been made. The investigation is ongoing, and officials have suspects in mind
MASSACHUSETTS ENACTS "NELLY'S BILL" TO EDUCATE DRIVERS Governor Mitt Romney signed House Bill 2124 into law on June 6, 2004, to require at least one hour of a motorcycle safety and awareness module be included in the course curriculum for 398 licensed auto driver training schools statewide. Known as "Nelly's Bill," in memory of Nelson Selig who was killed in 2000 when a 19-year-old driver crossed into the path of his motorcycle, the law will take affect in 90 days. VIRGINIA GOV VETOES SAFETY BILL Despite passing unanimously through the House and Senate, Governor Mark R. Warner has vetoed HB 408, a bill that would have required the marking of steel plates on Virginia roadways to make them more visible to drivers and riders. WEST COAST CHOPPERS GEAR BANNED FROM
CALIFORNIA SCHOOLS The Iron Cross, a recognizable SIOUX FALLS, S.D. -- Former U.S. Rep. Bill Janklow had just visited his mother and therefore was not on duty when he caused the crash that killed a man, a lawyer for the victim's family argued in documents filed in federal court this week. Attorney Ronald Meshbesher of Minneapolis said the visit would mean that Janklow was not on official business when he went through a stop sign near Trent, S.D., and collided with motorcyclist Randy Scott of Hardwick, Minn. But lawyers for Janklow and the federal government argue that he did not stop at his mother's home in Flandreau, S.D., and was within the scope of his job when he left an event in Aberdeen and headed for his home in Brandon. Monday's filings were in response to an appeal filed by Meshbesher, who wants a civil lawsuit filed by Scott's family returned to state court in Minnesota so the family can sue for larger punitive damages. This would not be allowed if Janklow were on official government duty when Scott was hit. A jury convicted Janklow, 64, of speeding, running a stop sign, reckless driving and second-degree manslaughter. He served a 100-day jail sentence and was released May 17. As it stands, the federal government, not Janklow, would pay any money awarded from the civil lawsuit. Meshbesher said Janklow and former chief of staff Chris Braendlin, who was with Janklow at the time, contradicted themselves in May 28 sworn depositions from what they told jurors at Janklow's trial in December. According to the deposition transcript, Janklow testified that he recalled turning on a certain road but cannot remember what happened after that or if he stopped at his mother's house. According to the transcript from Meshbesher's
latest court filing, Janklow later said no one had ever asked him if
